1. Agreement and eligibility
These Terms form a binding agreement between you or the organisation you represent and Resource Communications, the operator of Linkify. By creating an account, accepting an invitation, purchasing a plan, or using the service, you agree to these Terms and the documents they incorporate.
You must be legally capable of entering into this agreement. If you use Linkify for an organisation, you confirm that you have authority to bind it.
2. The Linkify service
Linkify provides tools for short links, QR codes, bio pages, landing pages, campaigns, forms, analytics, domains, teams, and related services. Features, limits, and availability vary by plan and may evolve over time.
Preview, beta, AI-assisted, experimental, or third-party-dependent features may be changed or withdrawn and should not be relied on for safety-critical or legally mandated decisions.
3. Accounts and workspaces
- Provide accurate account information and keep it current.
- Protect credentials, enable available security controls, and promptly report suspected compromise.
- Workspace owners control membership, roles, assets, and subscription decisions.
- You are responsible for activity under your account and for users you invite or authorise.
- Do not share accounts or bypass plan, security, access, or usage controls.
4. Customer content and permissions
You retain ownership of content you submit. You grant Linkify a worldwide, non-exclusive licence to host, process, reproduce, transmit, display, and adapt that content only as needed to provide, secure, support, and improve the service.
You confirm that you have all rights, notices, consents, and lawful bases needed for destinations, media, personal information, tracking, domains, forms, and embeds you publish. You remain responsible for your content and the relationship with visitors and subscribers.
5. Acceptable use
You must comply with our Acceptable Use Policy. Linkify may investigate, limit, archive, suspend, or remove content or accounts that create security, legal, operational, or reputational risk. We may preserve relevant records where legally permitted.
6. Links, public pages, analytics, and domains
- Redirects and public pages may stop working if an asset or workspace is paused, archived, deleted, expired, over its limit, unsafe, or suspended.
- Analytics may exclude or classify bots, repeated activity, privacy-restricted signals, or suspected abuse and are not guaranteed to match another platform.
- Custom-domain operation depends on DNS, certificates, hosting, registrars, and third parties outside Linkify’s control.
- You must not represent a Linkify-generated identifier as permanent where your plan, domain, or account may change.
7. Plans, fees, and taxes
Paid plans, billing periods, usage limits, trial terms, renewal rules, and prices are shown at purchase or in an applicable order. Unless stated otherwise, fees are due in advance, exclusive of taxes, and non-refundable except where law requires otherwise.
We may change prices on reasonable prior notice. Failure to pay may result in feature limits, suspension, or termination. Payment processing may be provided by an independent payment provider under its own terms.
8. Third-party services
Linkify may interoperate with third-party websites, maps, media, payment providers, domains, embeds, or integrations. We do not control and are not responsible for third-party services, content, availability, security, or terms. Your use of them is between you and the relevant provider.
9. Linkify intellectual property
Linkify and its software, interface, branding, templates, documentation, and underlying technology are owned by or licensed to us. Except for the limited right to use the service under these Terms, no rights are transferred to you. Feedback may be used without restriction or compensation.
10. Confidentiality
Each party must protect non-public information received from the other using reasonable care and use it only for this agreement. This does not cover information already lawfully known, independently developed, publicly available without breach, or rightfully received from another source. Required disclosures may be made where legally permitted after appropriate notice.
11. Suspension and termination
You may stop using Linkify and request account closure subject to outstanding obligations. We may suspend or terminate access for material breach, non-payment, security risk, abuse, legal requirements, or conduct that threatens the service or others.
On termination, access may end immediately. Provisions that by their nature should survive will survive, including payment, ownership, confidentiality, disclaimers, limitations, and dispute terms.
12. Warranties and disclaimers
Linkify is provided on an “as is” and “as available” basis to the maximum extent permitted by law. We do not warrant uninterrupted operation, error-free analytics, permanent availability of public URLs, or that the service will meet every legal, marketing, or business requirement. Nothing excludes warranties or rights that cannot lawfully be excluded.
13. Limitation of liability
To the maximum extent permitted by law, neither party is liable for indirect, incidental, special, punitive, or consequential loss, or for lost profit, revenue, goodwill, or data. Linkify’s aggregate liability relating to the service will not exceed the fees paid or payable for the affected service during the twelve months before the event giving rise to the claim. This limit does not apply where liability cannot legally be limited.
14. Your responsibility for claims
To the extent permitted by law, you will defend and indemnify Linkify from third-party claims arising from your customer content, unlawful tracking or communications, violation of another person’s rights, or material breach of these Terms or the Acceptable Use Policy.
15. Governing law and disputes
These Terms are governed by the laws of South Africa, without regard to conflict-of-law rules. The parties will first try in good faith to resolve disputes informally. Subject to mandatory law, the courts of South Africa have jurisdiction.
16. Changes and contact
We may update these Terms and will provide reasonable notice of material changes. Continued use after an update takes effect constitutes acceptance where permitted by law. Questions may be sent to privacy@linkify.global.
